Practice Notes

Practice Notes were introduced by the Industrial Court of Queensland and the Queensland Industrial Relations Commission to further assist persons or parties in their administrative dealings with the Commission.

Pursuant to rule 92 of the Industrial Relations (Tribunals) Rules 2011, the following practice notes have been issued for the guidance of parties to any proceedings.

PN 1 of 2014

Taking Evidence by Telephone or Video Link

The purpose of this Practice Note is:

  • to ensure that all parties are aware of the approach to the taking of evidence by telephone and video link in the ordinary case;
  • to streamline the taking o evidence by these means;
  • to avoid delay and disruption; and
  • to maintain the decorum of the proceeding.

The Practice Note has no application to conferences, including dismissal conferences and conferences conducted pursuant to s. 552A of the Workers' Compensation and Rehabilitation Act 2003.  It is applicable where submissions are to be made in a hearing.

PN 2 of 2014

Digitally Recorded Proceedings: Means of identifying proceeding, those appearing and witnesses

This Practice Note outlines the requirements that must be met to ensure the sufficient identification of:

  • the proceeding being recorded;
  • the legal representatives appearing, the representatives of industrial organisations, agents appearing or parties appearing in person; and
  • the names of the witnesses giving evidence.

This Practice Note takes effect from 3 March 2014.

Jurisdictional Documents in relation to Workers' Compensation Appeals

This Practice Note provides guidance regarding jurisdictional documents and requirements of the Commission in relation to Workers' Compensation Appeals.

This Practice Note takes effect from 10 March 2014.

Industrial Court of Queensland Robing

This Practice Note provides guidance regarding members of the Industrial Court of Queensland and counsel appearing before the Court being required to wear robes for trials, appeals and all other final hearings.

This Practice Note takes effect from 1 November 2014.

Industrial Court of Queensland Citation of Authority

The purpose of this Practice Note is:

  • to ensure that the Court is provided with the most authoritative and functional versions of relevant authorities; and
  • to encourage parties to limit their citation of authority to those judgements which are apt to assist the Court materially in resolving the real matters in dispute.

This Practice Note takes effect from 4 November 2014.

Industrial Court of Queensland Electronic devices in Courtrooms

The purpose of this Practice Note is to clarify which electronic devices may be used during Court and Commission proceedings.

This Practice Note takes effect from 4 November 2014.

Admissibility of Evidence of Matters Raised in Section 318 Conference

This Practice Note operates to clarify the position with regard to the admissibility into evidence in s. 319 proceedings of the Industrial Relations Act 2016 of communications made and/or documents produced in a conciliation conference required to be held by the Commission under s. 318 of the Act.

This Practice Note is to provide guidance on certain procedural issues associated with applications made under s. 475 Power to recover unpaid wages and superannuation contribution etc., of the Industrial Relations Act 2016.

This Practice Note is to provide guidance on the use of recording devices, mobile phones, laptop computers, personal digital assistants (pda's) and similar devices in Commission proceedings
